Federal District Judge Brian R. Martinotti had public docket entries deleted from pacer.gov, effectively assisting the government in covering up their illegal and grievous actions against Jose Torres. Judge Martinotti then unconstitutionally revoked Jose Torres’ right to represent himself for no legal or proper reason. The only explanation is that it is an attempt to cover up the DOJ Corruption that was uncovered by Whistleblower Torres who is an accountant and high-level consultant and always acted professionally and politely in the courtroom. Not only was the defendant’s right to represent himself revoked but Judge Martinotti made Torres wait six months, rather than the normal few weeks, prior to allowing Torres to represent himself. Meanwhile, Torres has been sitting in jail awaiting trial for over three years.

Jose Torres was arrested in a most unusual and unprecedented (mis)use of

a federal statute, Title 18 U.S.C.S. 2422(a), passed in 1910 to charge pimps and sex

traffickers. Jose Torres is a patron of prostitutes, not a pimp or trafficker. In New Jersey, a

patron of prostitutes is charged as a disorderly person’s offense that typically carries a $350 fine, not a 20 year jail sentence under this federal law 2422(a). The 2422(a) statute’s

congressional records state: “The legislation is not needed or intended as an aid to the States in the exercise of their police powers and the suppression or regulation of immorality in general. It does not attempt to regulate the practice of voluntary prostitution, but aims solely to prevent panderers and procurers from compelling thousands of women and girls against their will and desire to enter and continue in a life of prostitution.”

Unquestionably, Torres is neither a pimp or trafficker but merely a patron.

Torres was assigned a public defender who Torres felt was throwing the

case and thereafter submitted a motion to proceed pro se. Torres had uncovered the fact

that the new prosecutor Emma Spiro was previously employed by a private law firm, Sher Tremonte LLP, who had pending civil litigation against Mr. Torres. Emma Spiro then took a federal job with the Department of Justice and in less than 60 days initiated

federal prosecution against Torres. This is strictly prohibited by federal law, as federal

employees cannot use their new position of power to assist their former employers. The

law restricts a federal employee from engaging in any activity related to their former

employer for a minimum of 2 years. See Executive Order 13490, Order 74 FR 4673

(2009). Emma Spiro secreted this information away from the court and the defendant and it was not revealed until Torres uncovered it 18 months later. Conflicts of Interest are to be presented in advance, not after they are caught. Emma Spiro is joined by

federal prosecutors Bruce Keller and Shawn Barnes who, according to public records, has

a history of corruption and falsifying evidence.

In an action that effectively has hidden government corruption from the public, Judge

Brian Martinotti granted the Government’s motion for an injunction that removed all the facts of the DOJ corruption by Emma Spiro and the Sher Tremonte law firm off the records. United States Attorney, Philip Sellinger, doubled down to back up Emma Spiro and cover up the violation by writing a letter to Judge Brian Martinotti asking the judge to muzzle Torres.

Shortly thereafter, Torres’ right to defend himself was suddenly revoked and all his motions and facts of the corruption were removed from the public docket. There is more to this cover up than is currently known, but it is clear that federal law does not allow a prosecutor to charge citizens to help out their former employers. Judge Brian Martinotti’s action of revoking Torres’ Constitutional Right to represent himself and secreting away the facts from the public docket is an act similar to what occurs in communist dictatorships like North Korea, where people’s rights are easily taken away and corruption covered up nonchalantly.
