Review: I bought this book to study Aquinas on natural law. Dr. Budziszewski is witty and entertaining, and a gifted teacher. He makes each line of Aquinas clear, using the translation of the Dominican Fathers and his own translation side by side. The insights he offers in his commentaries are a joy to read! I leave each passage feeling enlightened and energized to think about what I've read and excited to read more!

Review: J. Budziszewski is a professor of philosophy at the University of Texas at Austin. He has written several excellent philosophy books, including three other superb commentaries on Thomas Aquinas’s treatises. The Commentary on Thomas Aquinas’s Treatise on Divine Law is a masterpiece in that it takes the brilliant work of Thomas Aquinas and translates it into clear, modern English, followed by discussions of what each section means.

Divine Law is perfect law and it is perfect wisdom. Both law and wisdom are essentially about morality, and this book explains the reasoning behind Divine Law. Here are some examples of insights provided in this book:

Divine law adds four things to the natural law:

1. The natural law directs us to how to be happy on earth, while divine law tells us how to attain eternal happiness in Heaven.
2. Human reason can make mistakes about the details of the natural law, but the Divine law is free from error because it is a revelation that comes from God.
3. Lawmakers cannot prohibit evil intentions because we cannot tell what is on people’s minds. The Divine law can prohibit and evil will and evil intentions because God sees everything.
4. Lawmakers cannot prohibit certain acts which the natural law says are wrong because prohibiting them would be impractical and would do away with many good things also. The Divine law is not limited by what is practical for men because God is all-powerful and omniscient and all wise.

Just as the intention of human law is to create friendship between man and man; so the chief intention of Divine law is to establish man in friendship with God. If we are not serving God, then we are serving something less than God.

The notion that we can ignore God and still seek the good rests on the facile and unconsidered assumption that God is one thing, and good is another. For what if God is our good? What if, in some sense, friendship with Him is our greatest good? That is exactly what St. Thomas proposes.

Human law aims chiefly at friendship among men, and the Divine Law aims chiefly at friendship between man and God. Now the reason for love is similarity between the lover and the beloved. Consequently, there cannot be friendship between man and the supremely good God unless man becomes good too. In the book of Leviticus, God says to man, “Be holy, for I am holy.”

God spares sinners; you wish Him at once to destroy sinners. God wishes to spare sinners. Be righteous in this life and endure evils with patience. Be assured that the day of God’s judgment will come.

Now man is placed between the goods of this world and the spiritual goods wherein eternal happiness lies. The more a man clints to material goods, the more he withdraws from spiritual goods. He who clings wholly to the things of this world, so as to make them his end, and to look upon them as the reason and rule of all he does, falls away altogether from spiritual goods. Nevertheless, for a man to gain his ultimate end, he does not need to renounce the things of this world altogether: since he can, while using the things of this world, attain to eternal happiness, provided he does not place his end in them.

The Enlightenment project to make a neutral ethics was a mistake, for neutrality is impossible. Have human beings a common moral ground? Yes, because there is one God, one human nature, and one natural law. But is our common ground a neutral ground? No. In fact, it is a very slippery one. Not all views of God, not all views of the structure of reality, not all views of human nature itself are equally adequate. Some views make it harder to see the common ground and harder to stand on it. Some views may even prevent us from wanting to stand on the common ground. Consider, for example, the view that God or human nature can change. St. Thomas holds that whatever in us can change is not in fact our nature, and that any god that can change is not in fact God. Beliefs in a human nature that can change in its essence, or in a God who can become what He is not, make it very difficult to see what really is our nature and to acknowledge what really is God.

As can be seen by reading the above excerpts, the Commentary on Thomas Aquinas’s Treatise on Divine Law is a powerful, profound and ennobling book of profound wisdom. If God’s not important, then nothing is important. That’s why this is an extremely important book.

Review: This book is one of the clearest explications of St. Thomas's doctrine of law that you'll find. It is chock-full of insight into some of the more difficult passages in the Summa and is burnished with wit in their explanation. If you are taking an odyssey into Aquinas's philosophical-theological ethics and politics, and are looking for a companion, then this is the book for you.
