Review: It is difficult to accurately gauge the stupidity of any lawyer accusing Alan Dershowitz of anything, let alone a sex offense, without the evidence to back it up. Is there anyone less likely to fight back and fight back both hard and publicly? Yet as is often the case, the spectrum of human stupidity includes shades not readily visible to the naked eye of the rest of us, as some lawyer was dumb enough to do just that. Dershowitz responded predictably. And it is marvelous!

As Dershowitz states, he has a long personal and professional reputation to uphold and so he took it upon himself to rebut the allegations of Virginia Roberts Giuffre, one of the girls allegedly exploited by Jeffrey Epstein. And rebut it he does. On multiple different fronts, Dershowitz does far more than create doubt about the accusation that he had sex with Giuffre, he affirmatively proves his innocence of such an act.

After putting the pieces together regarding the time frame at issue (incorrectly stated by Giuffre, with alleged memories so clear that it seriously calls into question how honest such errors in timing were), Dershowitz was able to account for every single day of the relevant two year period, destroying any contention that he could have had sex with Giuffre during the times and locations alleged.

Dershowitz goes further, detailing how he openly challenged Giuffre to make the accusation to the media, thereby making it unprotected by the litigation privilege to a defamation case. Giuffre refused to do so. Even more, Dershowitz demanded to be investigated and assigned Louis Freeh, former director of the FBI and former federal judge, to conduct an independent investigation of him. It came back that the accusation was not only unsupported but contradicted by much of the available evidence.

Dershowitz, pulling no punches (yeah, that’s a surprise, I’m sure), goes after several other lawyers in the process, starting with Giuffre’s own attorney. As Dershowitz points out, Giuffre had mentioned his name several times in relation to Epstein but never made an accusation against him until . . . wait for it . . . until her lawyers suggested she do so! Why? Because at the same time as she named Dershowitz in publicly available pleadings, she named others, far richer than Dershowitz, anonymously. Not surprisingly, one billionaire settled quickly after seeing how Dershowitz was being publicly treated after his name went public.

Dershowitz is half right when he argues that the ‘Me Too’ movement has resulted in significant unfairness in the area of sex accusations, in which burdens of proof in the court of public opinion have reversed, with presumptions of guilt being the norm. In fact, the ‘Me Too’ movement has merely been the latest hysteria of perpetually aggrieved feminists dating back at least to the Clarence Thomas hearings.

Dershowitz is correct that the falsely accused should have some redress in the courts. But he misses a point that is missed far too often. Ever since I first tangled with feminists (which has now been more times than I can count stretched over several decades), I have heard that it is really only the ‘radical feminists’ that are the problem, that ‘moderate feminists’ agree with much of my criticism. Yet these ‘moderate feminists’ only appear after I go on the attack, and even then are more concerned with the reputation of their ideology than they are with any damage to men. After all, if there are so many ‘moderates,’ exactly why does the current situation exist. Should not ‘moderate feminists’ have effectively dealt with this garbage years ago? After all, per their arguments, it is they, not the ‘radicals,’ who comprise the overwhelming majority of feminists. By sheer numbers, they should have marginalized the extremists long ago.

That has not happened, and it will not happen until we understand very clearly what stands in the way of justice for the falsely accused, most of whom are men. That would be an extremist ideology that, like every extremist ideology, requires only a small number to do the actual dirty work, but a larger number of adherents who may not get their hands dirty, but will not stop those who do, and who act as a rear-guard defense when the belief system comes under attack. If Dershowitz wants reform in these matters, he needs to recognize that and state it clearly and frequently.

Review: I don't like Alan Dershowtz. I started to dislike him during the OJ criminal case. Not because he was defending OJ. Afterall, that was his job and the U.S. Constitution says that criminal defendants have the right to counsel. I started to dislike him because his ultra high level of self-promotion did not, in my opinion, match his record of achievement. I really started disliking this guy when he referred to himself as the OJ Criminal Defense Team's, "constitutional strategist." I am from Ohio and in Ohio we have a name for "constitutional strategists." We call them criminal defense lawyers. Let's face it. Dershowtz, what a windbag!

Why is what I just said important? Because too many people in this country think people "did it," or "did not do it," in both civil, criminal and administrative law cases based on the accused's politics, backgrounds, the color of their skin, their religious views, their educations and all sorts of other irrelevant stuff. But the problem is that the one and only thing -THE ONE & ONLY THING - that should matter is the evidence. Somewhere , sometime too many people forgot about that. Rule #1 in contested legal cases: Evidence talks and everything else should walk. Rule #2 is that people should listen carefully to the evidence and then evaluate it using good judgment.

That is one of the lessons Dershowtz makes in this insightful book. He does not say sexaul harrassment is not real, because it is. He does not say that sexual assualt is not real, because it is. He does not say rape is not real, because it is. He does not say that it is okay to sexually harass, assualt or rape anybody, because it is not okay. It is not even close to okay. It is always 100% wrong. (I hope I have made that point reasonably clear.)

What Dershowtz says is that just because somebody says, or claims or alleges some terrible sexual event happened, and that X (fill in the blank) did it, does not make it so. Only evidence can make it so. (Remember Rule #1, from above.)

So I recommend this book. Before you call me a Commie, or whatever it is they are calling people like me these days, please know that I am a lawyer who has successfully represented women in sexual harrassment cases, and I have successfully represented men in sexual assulat cases and in rape cases. Many years ago I spent about 5 or 10 minutes working as an Intern in the Office of Rep. Bella S. Abzug of New York, who, back in "olden times" was big in The Women's Movement. And back then, it was not always easy to be part of The Women's Movement. (Frankly, my feelings about Bella are sort of similar to my feelings about Professor Dershwotz. Sorry, Bella. You were very smart, very hard working and totally dedicated to your beliefs, but you should have mixed some crazy glue in with your toothpaste. You would have gone a lot farther in politics if you had.)

Which is all just another way of saying: Show me the evidence. Evidence talks and everything else walks. If you don't believe me, read this book.
