Review: Why are we politically obliged to obey the law in our society? The author shows us that the demands of justice, fairness, Samaritanism, and political membership form the basis of such obligation. However, she also shows us that resistance to injustice through principled disobedience, is sometimes a better way to meet the demands of justice, fairness, Samaritanism, and political membership than sheer legal compliance is. Thus, we need to ‘extend the concept of political obligation to encompass citizens’ political responsibilities, including their moral duties to resist injustice and to engage in principled disobedience under certain circumstances.’ (P.10) Principled disobedience, morally or politically motivated may also include uncivil acts of disobedience that may preserve justice and democracy just as well as civil disobedience.

How do we understand disobedience when it is uncivil? ‘The basic norms of civility at the core of civil disobedience suggest the following features of uncivil disobedience: covertness, evasiveness, violence, and offensiveness. I prefer to simply say that acts of principled disobedience that are covert, evasive, anonymous, more than minimally destructive, or deliberately offensive are generally uncivil, especially if they display more than one of these traits.’ (P.44)

However, the natural duty of justice not only requires us to obey results arrived at under democratic system; it also requires us to resist and end injustices by means of disobedience when the law or system violates justice or does harm to democratic equality. In this case, ‘We should expand our repertoire of potentially acceptable modes of principled disobedience beyond civil disobedience, readily granting the incivility of certain disobedient acts and opening ourselves to the possibility that some types of uncivil disobedience can be justified.’ (P.39) On the other hand, in order to form beliefs and judgments about resistance in a responsible way, the author shows us the importance of the civic virtues of vigilance and open-mindedness.

The book is well-researched and the thesis cogently argued for. It promises to put forward a framework to assess disobedience that supports emancipatory struggles and ends injustices.
