Title: Insightful, scholarly survey of the use of language in Anglo-American law

Review: This scholarly book provides a fascinating survey on how language has been used in common law jurisdictions (primarily America and Great Britain), through the perspective of its history and development. The author discusses: (1) law language in England before the Norman Conquest; (2) the impact of Norman French on law language after the Norman Conquest; (3) the gradual transition in English courts and Parliament from using law French to using primarily law English; (4) the further development of law language as Middle English evolved into Modern English; (5) how colonial America adapted the language of English law to deal with the practical realities of the North American British colonies; and (6) how the language of American law developed after America gained its independence from Great Britain. The author’s historical survey is written in a scholarly, academic style that is enlivened by interesting and thought-provoking anecdotes, biographical sketches, examples, and vignettes. After completing the historical survey of the origins and development of law English, the author discusses how the legal profession has strived to make law English more precise, shorter, more intelligible, and more durable.

The author’s historical perspective of law language is the heart and soul of this book. The author’s use of historical perspective provides important observations and insights that (1) help the reader to better understand some of the peculiarities and nuances of law English, and (2) provide explanations of various words, phrases, and expressions used in law English that seem odd or baffling without knowledge of their origins and development.

Because of the scholarly nature of this book, I do not recommend it for casual reading. I strongly recommend it to any reader with a serious scholarly or professional interest in: (1) the language of Anglo-American law; (2) the history of Anglo-American law; (3) the importance of language to the rule of law; (4) how the English language has developed and evolved; and (5) how knowledge of historical context and historical developments can help better understand the ways a living language develops, changes, and adapts.

Review: This book is an exhaustively researched, scholarly treatment of legal language from its earliest days until the 1970s. The text is almost intimidating in its scope, but Mellinkoff's wit and piercing insights into legalese make it a joy to read.
Any lawyer who reads it will have many "aha" moments ("So THAT'S why we write that way"). Plus, you're bound to improve your writing ("I guess I can stop using that archaic word, now").
Also, this book should be required reading for everyone who teaches legal writing.
