The DOJ is Now targeting Johns from the Black and Brown Communities for Patronizing Escorts

In unprecedented use of federal law, the DOJ is now prosecuting johns for having consensual sex with adult escorts. The statute that is being used, Title 18 U.S.C.S. 2422(a), was passed in 1910 by Congress to prosecute pimps and sex traffickers – it has never seen a conviction of a john. This statute carries up to a 20-year sentence. The DOJ hopes that this will open a whole new era of prosecutions. This could target politicians, celebrities and public figures, along with married and single men alike.


Jose Torres, a Latino from New Jersey and an executive accountant and high level consultant, will take his case to trial on October 3, 2023 in Newark, New Jersey in front of Federal District Judge Brian Martinotti. Under New Jersey state law engaging in prostitution as a customer is a disorderly person’s offense – not even a misdemeanor. In New Jersey, a “john” would normally only be fined about $350 for this conduct.

Prosecutor, Emma Spiro, left her position with Sher Tremonte LLP, took a job with the DOJ as an Assistant U.S. Attorney and initiated this prosecution in under 60 days, even though the DOJ ethics manual and federal law prohibits her from taking on a case related to her former employer for a period of two years. This illegal “conflict of interest” has been ignored by the court and creates a significant violation of the defendant’s 6th amendment rights. Emma Spiro is joined by federal prosecutor Shawn Barnes who, according to public records, has a history of corruption and falsifying evidence as a Union County prosecutor.

In order to add gravity to the charges against Torres, prosecutor Emma Spiro manufactured false allegations of violence to prejudice and disparage the defendant and influence judges to deny Torres’ bail (five times). He has already been in jail awaiting trial since February of 2020, even though he has no prior criminal record.
