Under a Concealed Conflict of Interest, New Jersey Federal Prosecutor, Emma Spiro, Violated Federal Laws and the DOJ Code of Ethics to Arrest a John who was Involved in a Civil Case with her Former Employer, Sher Tremonte

Under a concealed conflict of interest, Assistant United States Attorney, Emma Spiro, initiated a federal criminal investigation against Jose Torres, a customer of escorts.

 





Presidential Executive Order 13490, Order 74 FR 4673 (2009) mandates: “Revolving Door Ban -All Appointees Entering Government. I will not for a period of 2 years from the date of my appointment participate in any particular matter involving specific parties that is directly and substantially related to my former employer or former clients, including regulations and contracts.

“Emma Spiro left her former private law firm, Sher Tremonte LLP, and in less than 60 days of federal employment, AUSA Emma Spiro initiated a prosecution against Jose Torres, who had sued her former employer in a civil case against. In effect, she brought substantial institutional knowledge from her former private employer firm and used it to prosecute Jose Torres in federal court in blatant violation of presidential orders, federal rules, codes of ethics and “appearance of impropriety.

“Not only did AUSA Emma Spiro violate Presidential Executive Order(s), but she also violated the Ethics Handbook for On and Off-Duty Conduct, from the U.S. Department of Justice; multiple Code of Federal Regulations, for example, Title 5 C.F.R. 502(d)(l)-(6), 735.203, 2635.101(b)(14), 2635.502; Title 18 U.S.C.S. 203, and the New Jersey Rules of Professional Conduct.

AUSA Spiro concealed all of this information until the defendant Jose Torres uncovered it 18 months later. Judges and lawyers are required to notify the court in advance of any potential conflicts of interest. Upon getting caught, AUSA Emma Spiro then obtained an Opinion letter after Torres reported the conflict of interest. This “after the fact” effort to hide the illegal conflict of interest with her former employer underscores her unethical and illegal actions.

Jose Torres’ trial is scheduled for October 3, 2023, at the Newark, NJ Federal Courthouse in front of Judge Brian R. Martinetti.
